WHAT YOU ARE BUILDING TOWARD
Make the registration dispute serve the bigger business goal.
You may need to preserve your own application, defend a registration, or challenge a competing claim. We help you connect the available TTAB options to the brand position you want to protect.
WHY TUCKER LAW
Your business in view.
Choose counsel who understands both the registration record and the commercial dispute behind it.
Why Choose Tucker Law for TTAB Proceedings
Tucker Law handles trademark filings and disputes. We can examine the challenged record alongside the parties’ positions and the evidence needed to support your case.
We explain what an opposition or cancellation can accomplish and when a broader infringement issue calls for separate consideration. Your objective helps determine the appropriate strategy.
We discuss the value of the mark, the strength of the record, and opportunities for a negotiated resolution so the proceeding stays connected to your commercial priorities.
MATCH THE FORUM TO THE GOAL
Understanding that distinction helps you choose the relief that fits the problem.
At the TTAB
Oppositions and cancellations concern whether a mark can register or remain registered.
Claims about infringement, orders stopping use, and monetary remedies require a different forum and their own legal showing.
THE PROTECTION BEHIND THE GOAL
TTAB Oppositions and Cancellations
Challenge a pending application
An opposition concerns an application that has reached the relevant publication stage. If a proposed registration threatens your position, Tucker Law can assess the grounds, timing, and supporting record. The decision to challenge should account for the actual mark, the goods or services, your rights, and what a successful result would mean commercially.
Defend an application you have invested in
Receiving an opposition does not by itself resolve who should prevail. We review the allegations and application history, assess the available defenses, and discuss the evidence and resources the matter may require. We also consider whether acceptable terms could resolve the dispute while protecting your objectives.
Challenge or defend an existing registration
A cancellation proceeding targets an existing registration. The grounds available can depend on the registration, its age, and the facts. Tucker Law can help evaluate a potential challenge or defend against one with attention to ownership, use, priority, and other issues relevant to the particular case.
Keep the record and settlement options aligned
A TTAB proceeding can involve pleadings, discovery, testimony, evidence, and briefing. We explain how those demands relate to the position being advanced and to potential resolution terms. A registration dispute may overlap with a marketplace disagreement, so any proposed settlement should be evaluated in that broader context.
WHICH POSITION ARE YOU PROTECTING?
We start with the brand interest you want to preserve, then assess the appropriate response.

QUESTIONS BEFORE YOU DECIDE
Trademark Opposition FAQs
Can the TTAB order a competitor to stop using its name?
No. The Board decides federal registration rights; it does not issue injunctions against use or award infringement damages. A separate court claim may need to be considered for those objectives.
Can Tucker Law defend an opposition or cancellation?
Yes. We can review the allegations, record, deadlines, and available defenses and discuss the representation the matter requires.
Should I act as soon as I receive a notice?
Yes. Send the notice and any related correspondence promptly so the relevant deadlines and procedural position can be assessed.
Can the parties settle?
They may be able to reach acceptable terms. Whether settlement is useful depends on what each party needs and how the terms address registration and any related use of the marks.
