TUCKER LAW / PATENT COUNSEL
Different proceedings. A deliberate strategy.
An examination appeal and a post-grant challenge raise different questions, procedures, and consequences.
WHY TUCKER LAW
Choose the proceeding that fits the issue.
A persuasive Board presentation starts with a precise issue, a supported argument, and counsel who understands the technical record.
Why choose Tucker Law for Patent Trial & Appeal matters?
Prosecution and post-grant perspective
Tucker Law’s patent practice includes applications, prosecution, and post-grant matters. We distinguish an appeal from an examiner’s rejection from a contested patentability proceeding and help assess the relevant route.
Technical issues explained through the record
Matthew Sean Tucker is a registered patent attorney and electrical engineer. We work through the claims, written disclosure, prior art, and reasoning to connect each argument to support in the record.
A reasoned recommendation before the next step
We discuss the decision at issue, procedural posture, available alternatives, and work involved. The objective is a clear basis for deciding whether to continue prosecution, pursue an appeal, or evaluate another Board proceeding.
CHOOSE THE BOARD PATHWAY
Identify the decision you need reviewed.
Examiner decision
Begin with the rejection, the response history, and the issue proposed for appeal.
Patentability challenge
Begin with the patent claims, asserted grounds, and the procedural route under consideration.
Different starting records call for different procedural analysis. Tucker Law helps identify the route before developing the argument.
HOW WE HELP
Focused support for your next step.
Appeals
Review examiner rejections
Assess the prosecution history, the disputed rejection, and the options for presenting the issue on appeal.
Challenges
Evaluate post-grant options
Consider whether an available proceeding, such as IPR or PGR, fits the patent, grounds, and timing involved.
Advocacy
Present a coherent record
Develop written arguments and supporting evidence, prepare for hearings, and coordinate related patent matters.
For applicants
An appeal should identify the examiner’s alleged error and connect the argument to the evidence already in the examination record.
For patent owners
A challenge calls for prompt attention to the asserted grounds, claim interpretation, cited references, and response opportunities.
For challengers
The requested relief, supporting evidence, procedural requirements, and effects on parallel disputes should be considered together.
PATENT TRIAL & APPEAL SERVICES
Preparing a patent appeal or PTAB proceeding
Appealing an examiner rejection
An appeal calls for identifying the alleged error in the rejection, not simply repeating that an invention is different. We review the claims, cited references, Office Actions, and prior responses to assess the disputed issues. The available options may include further prosecution or an appeal, depending on the application’s posture and your objectives.
Building the appeal brief
A persuasive brief explains the disagreement in an organized way and supports it with precise references to the record. Tucker Law helps frame the issues, address the examiner’s reasoning, and explain why the relevant technical distinction matters. Grouping of claims and the treatment of separate arguments deserve careful consideration.
Contested patentability proceedings
A petition challenging an issued patent raises different questions from an examination appeal. Eligibility, permitted grounds, evidence, timing, and effects on related litigation must be evaluated for the particular proceeding. Our inter partes review practice addresses IPR strategy for owners and challengers.
Oral hearings and the decision afterward
When an oral hearing is appropriate, preparation focuses on the questions the Board needs answered and the support already in the record. After a decision, we review its effect on the claims and available next steps. Further proceedings or judicial review depend on the decision and the applicable procedural requirements.

Matthew Sean Tucker’s practice includes patent prosecution, litigation, and post-grant matters. That experience helps place a Board dispute in the context of both the underlying technology and the history of the patent rights.

COMMON QUESTIONS
Know your next step.
Is a PTAB appeal the same as an IPR?
No. An appeal from an examiner’s rejection concerns examination of an application. IPR is a separate proceeding challenging issued patent claims on specified grounds.
Does the PTAB award infringement damages?
PTAB patentability proceedings do not decide an award of infringement damages. Court litigation raises distinct issues and may need to be coordinated.
Are all older PTAB procedures still available?
No. For example, the covered business method review program stopped accepting new petitions in 2020. The available path must be checked for the particular matter.
Can you help with an existing case?
Yes. Provide the case identifiers and the next deadline so we can review the posture and discuss the work needed.
Should I appeal a final rejection or continue prosecution?
That choice depends on the rejection, available amendments or evidence, the existing record, and the scope you want to pursue. Tucker Law can review those alternatives before you commit to an appeal.
Can Tucker Law review a matter already before the PTAB?
Yes. Provide the proceeding identifiers, recent papers, and scheduled deadlines. We can evaluate the current stage and discuss whether the work calls for a focused review or ongoing representation.
