THE ISSUE IN CONTEXT

Respond to the actual allegations.

Rule to know

Rule 3-23 requires a verified answer within 25 days of service. Under rule 3-23.1, default can admit charges and waive a hearing.

Specifications require attention to each allegation and the factual record behind it. Begin by separating what is admitted, what is disputed, and what needs further investigation. An informal narrative may not serve the same purpose as a response prepared for this stage.

Review the application, amendments, prior Board communications, and any investigative hearing record together. A position taken now should be assessed against the earlier record and available documents. Identify witnesses and exhibits based on what they can establish.

Tucker Law can discuss representation for the response and formal hearing process. Bring the complete service package promptly so counsel can review timing, allegations, and preparation needs.

Rule references reviewed September 23, 2026. Review the current rules and any instructions specific to your matter.

PREPARATION WITH A PURPOSE

Start with the facts.
Build from the record.

01

Confirm service and deadlines

Record how and when the papers were served. Have counsel calculate the applicable deadline and review any extension.

02

Analyze each allegation

Match the charge to prior statements, supporting records, and the facts you dispute or acknowledge.

03

Prepare for the next stage

Discuss response requirements, witnesses, exhibits, and the formal hearing with counsel.

FOR YOUR FIRST CONVERSATION

What to gather.

  • Specifications and all attachments
  • Proof and date of service
  • Filed application, amendments, and Board communications
  • Investigative hearing transcript, if available

Bring what you have and identify missing records. Counsel can discuss which additional materials may be useful.

COMMON QUESTIONS

Can I respond with a general letter?

Do not assume a letter satisfies the required answer. Review the formal response requirements with counsel.

Does requesting an extension automatically give me more time?

Do not treat a request as an approved extension. Confirm the Board’s action and the deadline that applies.

Are Specifications the same as a final denial?

They are formal charges. The procedural response and hearing rights require prompt attention; consult the applicable rules and counsel.
